Prawa operatorów serwisów źródłowych --------------------------------------- Treści, po które serwery sięgają (ogłoszenia, opisy, zdjęcia, oceny, zbiory ofert), należą do operatorów serwisów źródłowych lub do osób, które je tam zamieściły. Dotyczy to praw autorskich, praw producenta bazy danych (sui generis) i znaków towarowych. Nazwy serwisów i marek (Allegro, OLX, Booking, Google i inne) pojawiają się tu tylko po to, by wskazać, skąd pochodzą dane. Pozostają własnością uprawnionych. Wondel.ai nie rości sobie żadnych praw do danych źródłowych. 3. Przeznaczenie: użytek osobisty, testy i badania -------------------------------------------------- Serwery są przeznaczone do użytku osobistego. Osoba, która przez asystenta AI szuka czegoś na własne potrzeby (mieszkania, lotu, noclegu, ceny produktu), robi to samo, co zrobiłaby ręcznie na stronie źródłowej. To jest zamierzony zakres korzystania. Drugim celem są testy, badania i demonstracje integracji MCP: pokazanie, jak asystent AI może korzystać z publicznie dostępnych danych. Serwery są narzędziem eksperymentalnym, udostępnianym w stanie, w jakim są. 4. Zasady korzystania --------------------- Korzystając z serwerów, nie wolno: - masowo ani systematycznie odpytywać serwerów, żeby pobrać lub odtworzyć bazę danych serwisu źródłowego; - odsprzedawać wyników ani publicznie ich rozpowszechniać; - budować z wyników konkurencyjnych serwisów ogłoszeniowych ani baz cen; - używać wyników do trenowania modeli ani do tworzenia zbiorów danych; - masowo kontaktować się ze sprzedającymi lub ogłoszeniodawcami ani wykorzystywać ich danych do marketingu; - robić czegokolwiek, co narusza regulamin serwisu źródłowego lub prawo. Użytkownikowi, który łamie te zasady, możemy zablokować dostęp. 5. Brak licencji i odpowiedzialność użytkownika ----------------------------------------------- Ani ten dokument, ani działanie serwerów nie udzielają żadnej licencji do treści serwisów źródłowych. Jeśli planowane przez użytkownika wykorzystanie danych wymaga licencji lub zgody uprawnionego, użytkownik uzyskuje ją samodzielnie. Użytkownik odpowiada za zgodność swojego korzystania z regulaminem serwisu źródłowego i z prawem. 6. Jak serwery ograniczają wpływ na serwisy źródłowe ---------------------------------------------------- - Dane są pobierane na żądanie, dla jednego konkretnego zapytania. Serwery nie przeszukują serwisów automatycznie (crawling), nie pobierają ich w całości i nie budują ani nie udostępniają żadnej bazy treści źródłowych. - Każde wywołanie zwraca ograniczoną liczbę wyników, zwykle do kilkudziesięciu. - Wyniki są krótko buforowane (najczęściej od kilku minut do doby), co zmniejsza liczbę zapytań trafiających do serwisu źródłowego. - Wyniki zawierają, tam gdzie to możliwe, odnośnik do oryginalnego ogłoszenia lub strony, więc użytkownik trafia z powrotem do serwisu źródłowego. - Dane osobowe są ograniczone do minimum; narzędzia ogłoszeniowe nie zwracają numerów telefonu ani danych kontaktowych ogłoszeniodawców. - deweloperuch.pl jest odpytywany z każdej instancji serwera nie częściej niż raz na sekundę, jedno żądanie naraz. - Operator, który sobie tego nie życzy, pisze na support@wondel.ai; serwer zostaje wycofany (sekcja 10). 7. Podstawy prawne ------------------ W zakresie, w jakim mają zastosowanie: - Korzystanie z wyników na własne potrzeby mieści się w dozwolonym użytku osobistym (art. 23 ustawy o prawie autorskim i prawach pokrewnych). Przepis ten dotyczy użytku, jaki z wyników robi użytkownik końcowy, nie samego pobierania danych przez serwery. - Fakty, takie jak ceny, daty, rozkłady, kursy walut i dostępność, nie spełniają przesłanek utworu (art. 1 ust. 1 pr. aut.). - Dane pierwotne z rejestrów publicznych (np. Rejestru Cen Nieruchomości) i kursy NBP mogą być materiałami urzędowymi w rozumieniu art. 4 pr. aut. - Ustawa pozwala legalnemu użytkownikowi bazy korzystać z jej nieistotnej części w dowolnym celu (art. 7 ust. 1 ustawy o ochronie baz danych); pojedyncze wywołanie dotyczy takiej części. - TSUE w sprawie C-762/19 (CV-Online Latvia) uznał, że metawyszukiwarka odsyłająca do źródła narusza prawo sui generis tylko wtedy, gdy zagraża inwestycji producenta bazy. Serwery odsyłają do źródła i nie odtwarzają baz. - Nazwy i znaki towarowe serwisów są używane po to, by wskazać źródło danych, czyli informacyjnie (art. 156 ust. 1 pkt 3 Prawa własności przemysłowej; art. 14 ust. 1 lit. c rozporządzenia (UE) 2017/1001). To jest nasze stanowisko, nie rozstrzygnięcie. Każdy przypadek ocenia się osobno, a zgłoszenie operatora (sekcja 10) rozpatrujemy niezależnie od tego, jak sami oceniamy podstawę prawną. 8. Dane osobowe --------------- Serwery nie prowadzą kont użytkowników i nie profilują. Przetwarzamy treść zapytania (np. szukaną frazę, miejscowość, daty) po to, by je obsłużyć: zapytanie trafia do dostawców, przez których pobieramy dane (wyszukiwarki i usługi pośredniczące działające jako podmioty przetwarzające), a przy błędzie jest zapisywane w logach technicznych. Dane osobowe, które mogą pojawić się w treściach źródłowych (np. imię ogłoszeniodawcy), są przekazywane w minimalnym zakresie i buforowane tylko przez czas opisany w sekcji 6. Osoba, której dane się tam znalazły, może poprosić o ich usunięcie z pamięci podręcznej; pod tym samym adresem można zgłosić błędne dane: support@wondel.ai. 9. Brak gwarancji i ograniczenie odpowiedzialności -------------------------------------------------- Serwery są udostępniane w stanie, w jakim są, bez żadnych gwarancji. Dane mogą być nieaktualne, niekompletne lub błędne; ceny, dostępność i warunki zmieniają się u źródła. Przed decyzją (zakupem, rezerwacją, podpisaniem umowy) sprawdź je na stronie źródłowej. W zakresie dopuszczalnym przez prawo Wondel.ai nie odpowiada za szkody wynikłe z korzystania z serwerów ani z polegania na zwróconych danych. Serwery mogą zostać zmienione lub wyłączone bez zapowiedzi. 10. Zgłoszenia i kontakt ------------------------ Operator serwisu lub inny uprawniony, który nie chce, by serwer korzystał z jego serwisu, może napisać na support@wondel.ai. Serwer zostaje wycofany niezwłocznie: od tej chwili odpowiada kodem HTTP 451 (Unavailable For Legal Reasons), przestaje być ogłaszany w katalogach (Server Card, AI Catalog, llms.txt, katalog serwerów, rejestr MCP), a w catalog.json jest oznaczony jako wyłączony. Pod tym samym adresem przyjmujemy zgłoszenia błędnych danych oraz wnioski o usunięcie danych osobowych. 11. Lista serwerów i źródeł --------------------------- Patrz sekcja "Serwery i źródła / Servers and sources" na końcu dokumentu. 12. Prawo właściwe ------------------ Do tego dokumentu i do korzystania z serwerów stosuje się prawo polskie. Jeśli któreś postanowienie okaże się nieważne, pozostałe zachowują moc. Who and what --------------- mcp.wondel.ai is a set of experimental MCP (Model Context Protocol) servers run by Wondel.ai. On an AI assistant's request, each server fetches information from a website or official API and returns it in structured form, usually with a link to the source page. The servers are unofficial. Wondel.ai is not affiliated with the source operators, does not act on their behalf and is not authorised or endorsed by them. Access is free of charge and needs no account; Wondel.ai charges nothing and shows no ads. Each server and its tools are described at https://mcps.wondel.ai. This document: https://mcp.wondel.ai/legal.txt. 2. Rights of the source operators --------------------------------- The content the servers reach for (listings, descriptions, photos, ratings, collections of offers) belongs to the source operators or to the people who posted it there. This covers copyright, the sui generis database right and trademarks. Site and brand names (Allegro, OLX, Booking, Google and others) appear here only to say where the data comes from. They remain the property of their owners. Wondel.ai claims no rights in the source data. 3. Purpose: personal use, testing and research ---------------------------------------------- The servers are intended for personal use. A person who looks something up for their own needs through an AI assistant (a flat, a flight, a stay, a product price) does the same thing they would do by hand on the source site. That is the intended scope of use. The second purpose is testing, research and demonstration of MCP integrations: showing how an AI assistant can work with publicly available data. The servers are an experimental tool, provided as-is. 4. Acceptable use ----------------- When using the servers you may not: - query them in bulk or systematically to download or rebuild a source's database; - resell the results or redistribute them publicly; - build competing listing services or price databases from the results; - use the results to train models or to build datasets; - contact sellers or advertisers in bulk, or use their data for marketing; - do anything that breaches the source's terms or the law. A user who breaks these rules may have their access blocked. 5. No licence; the user's responsibility ---------------------------------------- Neither this document nor the servers' operation grants any licence to the content of the source sites. If the use a user plans needs a licence or the rights holder's consent, the user obtains it themselves. The user is responsible for keeping their use within the source's terms and the law. 6. How the servers limit their impact on the sources ---------------------------------------------------- - Data is fetched on demand, for one specific query. The servers do not crawl sites, do not download them in full, and neither build nor redistribute any database of source content. - Each call returns a capped number of results, typically up to a few dozen. - Results are cached briefly (mostly minutes, up to a day), which reduces the number of requests reaching the source. - Results keep, wherever possible, a link to the original listing or page, so the user goes back to the source site. - Personal data is kept to a minimum; the listing tools return no phone numbers or contact details of advertisers. - deweloperuch.pl is called at most one request at a time and one per second per server instance. - An operator who does not want this writes to support@wondel.ai and the server is withdrawn (section 10). 7. Legal bases -------------- To the extent they apply: - Using the results for one's own needs falls within permitted personal use (art. 23 of the Polish Act on Copyright and Related Rights). This concerns the end user's use of the results, not the servers' own fetching. - Facts such as prices, dates, timetables, exchange rates and availability do not meet the criteria of a work (art. 1(1) of the Copyright Act). - Raw data from public registers (e.g. the Real Estate Price Register, RCN) and NBP exchange rates may be official materials within the meaning of art. 4 of the Copyright Act. - The Act lets a lawful user of a database use an insubstantial part of it for any purpose (art. 7(1) of the Polish Act on the Protection of Databases); a single call concerns such a part. - In C-762/19 (CV-Online Latvia) the CJEU held that a meta-search tool linking back to the source infringes the sui generis right only where it harms the maker's investment. The servers link back and do not rebuild databases. - Site names and trademarks are used to identify the source of the data, i.e. nominatively (art. 156(1)(3) of the Polish Industrial Property Law; art. 14(1)(c) of Regulation (EU) 2017/1001). This is our position, not a ruling. Each case is assessed on its own, and an operator's request (section 10) is handled regardless of how we assess the legal basis. 8. Personal data ---------------- The servers keep no user accounts and do no profiling. We process the content of a query (e.g. the search phrase, place, dates) in order to serve it: the query is passed to the providers through which data is fetched (search and proxy providers acting as processors), and on an error it is recorded in technical logs. Personal data that may appear in source content (e.g. an advertiser's first name) is passed on minimally and cached only for the time described in section 6. Anyone who wants data about them removed from the cache, or who reports inaccurate data, writes to support@wondel.ai. 9. No warranty; limitation of liability --------------------------------------- The servers are provided as-is, without any warranty. Data may be stale, incomplete or wrong; prices, availability and terms change at the source. Verify them on the source site before any decision (a purchase, a booking, a contract). To the extent the law permits, Wondel.ai is not liable for damage arising from use of the servers or from reliance on the returned data. The servers may be changed or switched off without notice. 10. Takedown and contact ------------------------ A site operator or other rights holder who does not want a server to use their site can write to support@wondel.ai. The server is withdrawn promptly: from then on it answers HTTP 451 (Unavailable For Legal Reasons), is no longer advertised in any catalogue (Server Card, AI Catalog, llms.txt, the server directory, the MCP Registry) and is marked disabled in catalog.json. The same address takes reports of inaccurate data and requests to remove personal data. 11. Servers and sources ----------------------- See the section "Serwery i źródła / Servers and sources" at the end of this document. 12. Governing law ----------------- Polish law governs this document and the use of the servers. If any provision proves invalid, the rest remains in force.
